Alabama Ice Cream Shop Owners Arrested After Confrontation Over One-Star Google Review

Two Alabama ice cream shop owners have been released from jail after a confrontation over a one-star Google review led to misdemeanor charges and a viral video.

Malary Goldman and Ryan Goldman, owners of The Local Scoop Ice Cream Shop in Bay Minette, were arrested Thursday, June 11, after a June 7 encounter with customer Daniel Smit. Local station WALA reported both were arrested and released from Baldwin County Jail the next day.

The dispute began with a negative Google review Smit posted after visiting the shop during its grand opening period in March. The review later became the focus of an in-person confrontation that moved from a roadside encounter to a parking lot.

Jail records cited by local reports show no court date had been listed as of the latest update. The shop’s Google listing showed the business was still open.

Review led to parking lot meeting

Smit said he was working as a food delivery driver when Malary Goldman recognized him at a stoplight and asked to speak with him about the review. He agreed to meet her after completing a delivery stop.

The conversation took place in a Bay Minette parking lot. Smit said the discussion became hostile, and he began recording the exchange on his phone.

WEAR News aired the customer’s account of the confrontation, including his claim that the encounter escalated after Ryan Goldman arrived. The video shows Ryan Goldman joining the exchange. Smit alleged that his phone was knocked from his hand and damaged. Those allegations have not been tested in court.

Charges remain allegations

Local reports identified the charges as misdemeanor harassment and criminal mischief. Malary Goldman was charged with harassment and criminal mischief. Ryan Goldman was charged with harassment.

Alabama law defines harassment as conduct that can include physical contact, abusive language, obscene gestures, or threats made with the intent to harass, annoy, or alarm another person. Harassment is listed as a Class C misdemeanor.

State law also defines criminal mischief as intentionally damaging property without a legal right to do so. Third-degree criminal mischief applies when damage does not exceed $500 and is listed as a Class B misdemeanor.

The charges are allegations. The Goldmans have not been convicted of any crime related to the incident.

The video spread across Facebook.

The confrontation gained wider attention after the video spread on Facebook. WALA reported that the footage drew hundreds of thousands of views.

The video shifted the dispute from a local customer service complaint to a public controversy. Viewers reacted to the confrontation, the original review, and the conduct shown in the recording.

Smit told WALA he regretted parts of what he said during the exchange. He said he wanted to learn from the incident and move on. Malary and Ryan Goldman did not respond to WALA’s request for comment for its report.

Supplier reportedly cut ties.

The fallout also appeared to reach the business’s supply chain. Smit told WALA that the shop’s ice cream supplier had contacted him and said it would no longer do business with The Local Scoop.

Lagniappe Mobile reported Cammie’s Old Dutch, a Mobile-based ice cream distributor, had announced it would stop supplying the shop. The report said the distributor described the shop as no longer being a wholesale account for its brand. The company’s reported decision added a business consequence to the legal and public-relations fallout.

The Local Scoop’s operating status remained unchanged in the latest WALA report, which noted that its Google page still showed the business open.

Dispute highlights risk of online review conflicts.

The Bay Minette case shows how quickly online criticism can move into real-world conflict. For small businesses, public reviews can affect early customer traffic, especially after a grand opening.

But consumer reviews are also a routine part of modern business. Customers use Google reviews to describe service, pricing, cleanliness, wait times, and product quality. Business owners often respond publicly or contact platform administrators if they believe a review violates the platform’s policies.

A direct in-person confrontation carries different risks. It can create safety concerns, lead to criminal complaints, and draw public scrutiny beyond the original review. In this case, the review itself is no longer the central issue. The arrests, the video, the alleged phone damage, and the business fallout have become the main public record.

The Goldmans were arrested on June 11 and released from Baldwin County Jail the next day. Local reports said no court date had appeared in jail records at the time of publication.

Smit has said he is ready to move forward. He also said he plans to continue reviewing restaurants. The Local Scoop Ice Cream Shop remains listed as open. No additional charges, court proceedings, or official police updates have been publicly reported in the latest available local coverage.
